Tensions in Kano Emirate: Chief Justice Summons Judges Over Conflicting Orders

AMID CONFLICTING interim injunctions that have plunged the Kano Emirate into a state of confusion and uncertainty, the Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, has summoned the Chief Judge of the Federal High Court and the Chief Judge of the Kano State High Court.

In a resolute action, the Federal High Court in Kano, led by Justice S.A. Amobeda, issued an order mandating the eviction of Emir Muhammadu Sanusi II from the Kofar Kudu Palace.

This order reinforced the authority of the 15th Emir of Kano, Aminu Ado Bayero. Justice Amobeda declared, “An order of interim injunction restraining the respondents from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, or infringing on his rights is hereby granted.”

He emphasized that this injunction ensures Emir Aminu Bayero retains all rights and privileges associated with his esteemed position.

In stark contrast, the Kano State High Court, under Justice Amina Adamu Aliyu, issued a conflicting injunction aimed at protecting Muhammadu Sanusi and other significant figures from potential harassment by state authorities.

This injunction specifically prevents any interference with the Emir’s autonomy and prohibits the seizure of key symbols of his authority, including the twin spear, the Royal Hat of Dabo, and the Ostrich-feathered shoes.

Justice Aliyu asserted, “An order of interim injunction is granted restraining the Respondents from harassing or intimidating the Applicants or confiscating any symbols of the Emir’s authority.”

She further mandated, “The respondents are ordered to maintain the status quo pending the hearing and determination of the motion on notice.”

These contradictory judicial decisions have sparked considerable confusion over the rightful authority and protection of the emirs in Kano.

The situation remains tense as the State High Court’s case is scheduled for further hearing on June 13, while the Federal High Court has adjourned its proceedings to June 4.
