JUST IN: Court Grants Dele Farotimi Bail Amid Defamation Allegations

THE EKITI State High Court has granted bail to lawyer and activist Dele Farotimi, following his recent arrest over alleged defamation linked to Chief Afe Babalola.

The court set bail at ₦50 million, requiring a surety with the same sum in a landed property. Further proceedings were adjourned to 29 January 2025.

Farotimi faced legal action after Chief Afe Babalola, a 95-year-old Senior Advocate of Nigeria (SAN), accused him of defamation in his book, Nigeria and Its Criminal Justice System.

Babalola claimed the book contained damaging statements against his person and character.

Farotimi’s arrest by the Ekiti State Police Command drew widespread criticism.

Civil society organisations, legal practitioners, and the Nigerian Bar Association condemned the detention, demanding his immediate release.

Many described the arrest as an attack on free speech and the right to dissent.

This case underscores ongoing tensions between free expression and the limits of defamation laws in Nigeria.

Farotimi’s supporters argue that the case highlights the broader issue of stifling dissenting voices, especially within the legal and activist community.

But many argued that these claims allegedly exposed Babalola to contempt, ridicule, and reputational harm.

Farotimi who was arrested in Lagos and transferred to Ekiti State, was initially denied his bail application, citing insufficient grounds to exercise discretion, and ordered his detention at the Ado-Ekiti Correctional Centre.

The prosecution emphasized the ongoing investigation and potential involvement of other individuals.

Meanwhile, Farotimi’s defense team argued for bail, pointing out his legal career of over 25 years and his health concerns.

This case has drawn criticism, and condemnations across Nigeria and from international community.

The hearing on 29 January 2025 will determine the next chapter in this high-profile case, which continues to spark public debate about justice and accountability.
