SEEKING TO obtain evidence from Nigerian President Bola Tinubu and DCI Group, Inc, Aaron Greenspan has been rebuffed by a United States (US) Federal Court in an ongoing Freedom of Information Act (FOIA) dispute involving the FBI and the Drug Enforcement Administration (DEA).
JKNewsMedia.com reports that the United States District Court for the District of Columbia ruled on October 30 that the proposed discovery concerning alleged cyberattacks on Greenspan’s website lacked sufficient relevance to the underlying FOIA dispute.
The decision prevents Greenspan from using the proceedings to pursue discovery that the court considers unrelated to the legal questions before it.
“The Court’s decision makes clear that this Freedom of Information Act (FOIA) proceeding cannot be used to pursue discovery unrelated to the legal questions before it,” attorney Christopher W. Carmichael said.
“By denying the request for discovery against President Tinubu and DCI Group, the Court reinforced the importance of keeping this litigation focused on the issues properly before it,” he added.
Also rejecting a separate application by nonparty Karl Von Batten for permission to submit an amicus curiae brief, the court said it is one which allows a person or organisation not directly involved in a case to offer arguments to assist the court.
Greenspan’s related request for judicial notice also failed, while the court separately denied his motion for summary judgment.
Attorney Oluwole Afolabi said the decisions established procedural boundaries for the ongoing litigation while clarifying the matters the court could properly consider.
“The Court also denied the plaintiff’s motion for summary judgment and rejected a separate request to introduce an amicus brief,” Afolabi said.
“While the underlying FOIA issues remain before the Court, these rulings establish important procedural boundaries and clarify which matters are appropriate for consideration in this litigation.”
However, the main case over the FOIA requests to the FBI and DEA is still ongoing, even though the court rejected the discovery application and the other motions.
